1. Processing of personal data by TikTok
When you visit our TikTok page, personal data is processed both by TikTok and by us. We have no influence on the nature and scope of the data processed by TikTok, the nature of the processing, and the use or disclosure of said data to third parties.
When you are logged in to TikTok with your TikTok account, your data will be directly associated with your account. If you do not wish to be associated with your profile on TikTok, you must log out before visiting our TikTok for Business page. TikTok, however, will also obtain data when you use the TikTok app without an account.
TikTok collects and processes personal data when you use TikTok, i.e. when you visit, log in or otherwise use TikTok. Such data includes:

· Information about your friends, in-app purchases and messages
· Metadata (when, where and by whom the content was created)

This information is used, among other things, to provide us with statistical data collected for our TikTok page as part of TikTok Insights (see section 2) about the use of our channel.
If our TikTok page is no longer operational, your data will be deleted to the extent possible on our behalf. We have no influence on any further storage of said data by TikTok.
2. Data analysis and TikTok Insights
All data analysed by TikTok and displayed to us in TikTok Insights is used in anonymised form. This means that we, as the page administrator, cannot draw any conclusions about individuals or a user's personal profile data. However, this does not necessarily mean that TikTok itself collects and processes data in anonymised form. We are not authorised to make decisions regarding the processing of Insights data.
However, TikTok also analyses the content you share based on the topics you are interested in, stores and processes confidential messages that you send directly to other users, and can determine your location using GPS data, information on wireless networks or via your IP address in order to send you advertisements or other content. If you log in from multiple devices, TikTok can use your profile data to analyse your activity across such devices.

As part of the Pro account, TikTok provides us with performance data for our channel and individual videos in terms of performance and target group, using current metrics and reports for a selected period. Such data includes:
· Total number of all video views, website clicks, contact clicks and app download clicks
· Follower activity; total number and development of followers
· Demographics of new followers (gender and top regions)
· Public areas (public reached and countries)
· Music tracks listened to by followers
· Video trends, content viewed in the last seven days, messages received
· Total number and development of profile views
· Types of traffic sources
· Total playback time and average playback time
· Number of likes, comments and shares
We do not use social plug-ins on our website; instead, we only place links to the corresponding pages. No explicit data is collected from TikTok when you visit our website.
3. Purposes of processing
In the context of the Pro account, the processing of information is intended to allow TikTok to personalise the content you receive and to provide you with tailor-made content that may be of interest to you.
We use the available data in aggregated form in order to make the posts and activities on our TikTok page more attractive to users. In order to better understand how we can achieve our goals better and more effectively with our TikTok page, demographic and geographic assessments are created and made available to us based on the information collected. We can use this information to display targeted, interest-based advertisements without obtaining direct knowledge of the visitor's identity. As an example, we use the distributions by gender and top regions to adapt greetings as well as users' preferred visit times to schedule our posts for the optimal time.
Visitor statistics created are transmitted to us by TikTok exclusively in anonymised form. We do not have access to the underlying data.
4. Contact and interactions
Our TikTok page offers you the opportunity to respond to our posts, share them, comment on them and send us private messages. The nature, scope and duration of the processing and storage of personal data as part of comments, likes or other activities on the TikTok page are determined by TikTok.
When certain interactive features are used by registered users, comments or likes are visible to us as well as other users. A direct user allocation can therefore be made based on the personal data disclosed. It is always possible to visit our TikTok page without leaving any comments or clicking on "Like".
When you contact us, we will receive your username, the text contained in the request and, if applicable, other personal data shared by you. The information you provide is processed as described in our Privacy Policy at www.bruder.de/en/footer/data-privacy.html. If you wish to prevent TikTok from processing any personal data you have transmitted to us, please contact us using another method.
5. Legal bases
We operate this TikTok page to present to and communicate with TikTok users and other interested parties who visit our TikTok page. The processing of users' personal data is based on our legitimate interest in an optimised company presentation (Article 6(1)(f) of the GDPR).
If you are registered with TikTok, you can send us a message using the "Message" function. Such messages are not visible to other TikTok users. We will only process the personal data contained in a message you send us in order to respond to your request. This represents our legitimate interest. The legal basis for such processing is Article 6(1)(a) or (f) of the GDPR. If a request is made to implement or initiate a contractual relationship, the legal basis is Article 6(1)(b) of the GDPR. 6. Forwarding of data and data transfer to third party countries
When you use TikTok, your personal data will be collected, transferred, stored, disclosed and used by TikTok. The data collected will be forwarded to third party countries (servers in the USA, Malaysia and Singapore), in particular within the corporate group ByteDance Ltd. (China).
TikTok states in their Privacy Policy that a transfer outside the EEA shall take place within the framework of EU law or pursuant to a substitute mechanism approved under EU law.
We cannot rule out the transfer and further processing of users' personal data by TikTok in third party countries and to third parties, as well as the associated potential risks for users. We have no influence on such transfer.

I. Response times
We try to respond to your inquiries, comments and private messages as quickly as possible. However, we ask for your understanding if there is a slight delay in responding. Sometimes we need to obtain further information or coordinate with other departments. Generally, we try to answer your messages as quickly as possible. II Personal data
The publication of personal data (addresses, telephone numbers, etc.) is not permitted. The BRUDER Spielwaren social media team will delete comments or posts with personal content immediately. III. User-generated content
We invite you to share your BRUDER pictures with us via social media. For this purpose, we have created certain hashtags (#justliketherealthing, #bruderspielwaren, #brudertoys, #bruderfleet, #bruderfans, for dealers: #bruderspecialist, #wesellBRUDER). We are happy to share your pictures on our channels (Facebook, Facebook Story, Instagram, Instagram Story, Instagram Reels). This will only be done after prior request via private messenger function of the corresponding channel and written permission of the creator.
With your written permission, you confirm that:
- You are at least 18 years old,
- own all rights to the photo/video described,
- You have the permission of the persons depicted in the photo/video and
- The use of the content does not violate the rights of third parties or the law

IV. Removal and blocking of inappropriate content
We reserve the right to remove inappropriate, offensive, discriminatory, violence-glorifying or infringing third-party content from our social media pages and to block the creator. We also reserve the right to remove comments and posts that are identified as SPAM, as well as comments that are published with fraudulent intent. We may also delete postings on the site that promote people or products that are not related to BRUDER Spielwaren.
We also reserve the right to block comments and their authors that are directed against BRUDER, BRUDER employees or other users.
